No Jurors Chosen Tuesday for Komisarjevsky Trial

The defense so far has used up half of its peremptory challenges.

No jurors were chosen Tuesday for the trial of Joshua Komisarjevsky, leaving the total so far at eight.

Sources knowledgeable about jury selection for the case in New Haven Superior Court said the defense used two peremptory challenges Tuesday and state prosecutors used one.

Lawyers may use peremptory challenges to excuse jurors from jury service without giving a reason.

Each side in this case may use up to 40 challenges. As of today, the defense has used 18 and the state has used 13.

Jury selection resumed at 10 a.m. Wednesday in the courtroom of Judge Jon C. Blue, who has scheduled the trial to begin on Sept. 19.

Komisarjevsky faces the death penalty for his part in the Cheshire home invasion triple homicide in 2007. His co-defendant, Steven Hayes, was convicted in 2010 and is on death row appealing his death sentence.

Three men and five women have been chosen for the jury. Blue told defense lawyers and prosecutors they must choose 12 regular jurors, six alternates and three backup alternates.
